Town Board Minutes-February 12, 2008

Minutes of the Franklinville Town Board Meeting held on February 12, 2008, at 7:00 P.M.

Meeting was called to order by Mr. Dickinson at 7:00 P.M. The Pledge of Allegiance was recited. Roll call was taken, with one absent.

                        

Mr. Gerstung made a motion to approve the minutes of the January 8, 2008, meeting, as presented by the Town Clerk, seconded by Mr. Brisky. All voted “Aye”. Carried.

 

Mr. Gerstung made a motion to go into Public Hearing to discuss Local Law # 2-2008, Designating the office of Town Superintendent of Highways as an appointive office, seconded by Mr. Brisky. All voted “Aye”. Carried.


 
Mr. Gerstung said that he believes that this is a good law allowing the Town Board more oversight of the Superintendent. Supervisor mentioned that if the current Superintendent retires before the end of his term and someone is appointed to fill his term, that person could lose at the following election. This law would offer more stability for the job of Highway Supt. It could also be a good thing if, in the future, the Town and Village combine services.


Mr. Gerstung made a motion to return to regular session, seconded by Mr. Bentley. All voted “Aye”. Carried.


Mr. Brisky made a motion to adopt Local Law #2-2008, as presented. Mr. Gerstung seconded the motion. By Roll Call, the vote was as follows:

This Law will go before the voters on the November 2008 ballot for their approval.

 
There was no Cemetery Sexton Report

 

Code Enforcement Officer Hatch thanked the Town Board for allowing him to attend the Code Conference in Buffalo in January. He was able to receive all of his yearly training there.  Several issues were brought up at the conference regarding changes in regulations governing inflatable pools and the Energy Conservation Code. Mr. Hatch sent the annual report to the State in January. CEO Hatch suggested that the Board look into legislation trying to get NYS to reinstate returning to localities insurance surcharges collected by the State to pay for Code Enforcement.


Mr. Hatch said that Code Enforcement Officer cannot require liability insurance for contractors if it is not contained in the Local Law, which it is not. This should be addressed. The State has established a committee to require sprinkler systems in new builds.


Supervisor asked if there will be a fee for 911 signs installed in the future. The fee was set at $15.00 for new signs to be installed.

 


DCO Florkowski is having some health issues.

The secondary contract with the SPCA was presented. Mr. Bentley made a motion to have Supervisor sign the contract, seconded by Mr. Dallas. All voted “Aye”. Carried.


Supervisor presented the 2007 financial report.

 


Mr. Dickinson made a motion to re-appoint Russell Hatch to the Board of Assessment Review, seconded by Mr. Bentley. All voted “Aye”. Carried.

 

Assessor Kay Reynolds could not be at the meeting due to the weather. She sent a letter offering to take pictures in preparation for a reval at $10.00 per parcel. Mr. Gerstung made a motion to table the issue and forward it to the Finance and Budget Committee which will report on it at the next meeting. Mr. Brisky seconded the motion. All voted “Aye”. Carried.

 
Mr. Gerstung made a motion to authorize Supervisor to sign letters to Senator Cathy Young and Assemblyman Joseph Giglio requesting funds from the Legislative Member Item budget to do paving at Case Lake. The motion was seconded by Mr. Bentley. All voted “Aye”. Carried.

 

Mr. Gerstung met with engineers from the MRB Group to look over proposed plans to renovate Morgan Hall. Parking is an issue. The house next to Morgan Hall may become available for purchase, providing 25 parking spaces.

 

Mr. Gerstung reported that there is $25,000.00 available for playground equipment at Case Lake. He said that he is just waiting for the contract to come in for Supervisor’s signature.

 

Mr. Brisky reported that Don Watkins would like to meet with Supt. Weller to get the Highway Department computer online. He would also like to show the Clerk how to add content to the Town website.

 

Mr. Dickinson will look into getting more copies of the Town Law book at the Association of Towns Conference in NYC.

 

Mr. Bentley reported that the Equipment Committee has not met with Supt. Weller yet.

 

Mr. Dickinson and Mr. Gerstung reported that the Finance Committee went over Supt. Weller’s budget requests.  They recommended implementing a procurement policy so all departments will know how much can be spent without Board approval and setting up reserve equipment accounts. Mr. Bentley made a motion to adopt the Finance Committee Report, seconded by Mr. Gerstung. All voted “Aye”. Carried.

 
Mr. Gerstung and Mr. Brisky reported that the Planning, Economic Development and Public Relations Committee met with the Highway workers to discuss issues and concerns. Mr. Dickinson made a motion to adopt the Committee’s report, seconded by Mr. Gerstung. All voted “Aye”. Carried.

 

The Clerk, Justice and Historian Reports were presented.


Mr. Dallas made a motion to pay Highway bills #5-20, Abstract #1 from 2007 funds, seconded by Mr. Gerstung. All voted “Aye”. Carried.

 

Mr. Bentley made a motion to pay General Abstract #2 for $21,499.49 and Highway Abstract #2 for $41,896.83, seconded by Mr. Gerstung. All voted “Aye”. Carried.

 
Mr. Dallas made a motion to go into Executive Session and then adjourn, seconded by Mr. Gerstung. All voted “Aye”. Carried.
